The Board is voting to adopt Policy 249, which extends disciplinary authority to student cyberbullying that occurs off-campus on personal devices. The policy’s broad definition of bullying, even when tied to a ‘substantial disruption’ standard, creates a risk of being misapplied to punish protected student speech on controversial topics.

PRE-VOTE ACTION: Item 12.F approves Policy 249. Send a pre-adoption legal notice to the Board identifying the potential for the policy’s broad language to chill or punish protected off-campus student speech, particularly on matters of public concern, in violation of the First Amendment.
